A woman is suing Bill O'Reilly for allegedly violating a settlement agreement in a sexual harassment case by badmouthing her to the press, according to a lawsuit filed Monday.

"Fox News has been aware of complaints about inappropriate behavior by Mr. O'Reilly since at least 2002, when Mr. O'Reilly stormed into the newsroom and screamed at a young producer, according to current and former employees, some of whom witnessed the incident".

"Knowing Ms. Bernstein and O'Reilly's other victims are afraid to speak out because he and Fox forced them to sign non-disclosure agreements, O'Reilly and Fox have made false and disparaging claims", Mullin added Monday in a statement on the suit and the confidentiality clause the plaintiffs seemingly trampled all over.

Rachel Witlieb Bernstein claims in her U.S. District Court for the Southern District of NY suit Bernstein v. O'Reilly, 17-cv-09483, that she was not the source of information for the April 1 story that appeared in the Times. Bernstein had complained about abuse, non-sexual in nature, by O'Reilly when she worked at Fox.

Rachel Witlieb Bernstein, a previous junior maker at Fox News, is one of six ladies who supposedly went into settlement assentions in the wake of claiming misuse by O'Reilly.

The Times reported in April that O'Reilly and Fox News paid out millions of dollars to five women to settle harassment claims. In my more than 20 years at Fox News Channel, no one has ever filed a complaint about me with the Human Resources Department, even on the anonymous hotline.

That line, as well as other public statements, represented a breach of his settlement deal with Bernstein, she alleges in Manhattan Federal Court. She accused him of forcing her into a "nonconsensual relationship". "They should release all victims from their NDS and let the truth out".

Neither reps for FNC nor O'Reilly replied to request for comment on the suit.

She argued that O'Reilly publicly disparaged her after she settled a harassment lawsuit with him in 2002. "This is false. In fact, he is a serial abuser and Ms. Bernstein's complaints about him were far from extortionate".

Bernstein's suit claims emotional distress as well as reputational and financial harm. "The statement by Fox News also violated the Confidentiality Clause in the Agreement".
