Lawyers for Brock Turner filed an appeal in California, saying their client was denied due process during his 2016 trial and calling it "fundamentally unfair".

Turner's victim, identified as "Emily Doe", made a powerful statement at his sentencing that drew worldwide attention and went viral.

Mr Multhaup argued a prosecutor in the trial incorrectly told jurors the sexual assault occurred behind a rubbish skip, or dumpster.

Turner was convicted of three felony counts of sexual assault.

Santa Clara County District Attorney Jeff Rosen told the Mercury News on Friday that Turner "received a fair trial and was justly convicted".

Following the jury's verdict previous year, Turner was ordered to add his name to the sex offender's register.

The appeal said the use of the term dumpster "implied moral depravity, callousness and culpability on the appellant's part because of the inherent connotations of filth, garbage, detritus and criminal activity frequently generally associated with dumpsters".

'His conviction will be upheld.

Turner's trial was thrown into the national spotlight after the victim's wrenching impact statement went viral, then again when Superior Court Judge Aaron Persky gave Turner to a six-month jail sentence, prompting an outcry from critics who said the punishment was too lenient.

The lawyers argue the jury did not see sufficient evidence to represent Turner's character, and that the jury was not permitted to consider a lower-level offense. "Nothing can ever roll back (the victim's) legacy of raising the world's awareness about sexual assault".

Turner was released for good behavior after serving just half the sentence imposed. At the time of his case, he was a decorated swimmer at Stanford.

Stanford law professor Michele Dauber, who is on a committee to recall the judge who sentenced Turner, said it's common for people to appeal.

In response to the Turner case, California lawmakers a year ago passed legislation to broaden the state's legal definition of rape and mandate prison if the victim was unconscious.
