Delhi: 4-year-old boy booked for 'raping' classmate in school

A case of rape under the Protection of Children from Sexual Offences (POCSO) Act has been registered against the accused.

Dependra Pathak, Delhi Police's chief spokesperson told Hindustan Times: "The Indian Penal Code (IPC) provides children below seven years of age certain protections against prosecutions". Accusing the school of negligence, the girl's mother said she had informed the school authorities but they did not take any action.

According to media reports, the victim told her parents that a boy in her class unbuttoned her trousers, used a finger and a sharpened pencil to assault her.

Then they approached the police with their complaint.

The parents, after doctors confirmed sexual assault, went to the police to report the incident. She also said the boy "sharpened his pencil and put it in too". "When she returned home, she kept drawing my attention to her pain and injury to her private parts".

According to the police, the minor victim was sexually assaulted by her classmate in the school's classroom as well as the bathroom in the absence of staff.

The mother of the girl has also alleged inaction by school authorities, she had complained to a schoolteacher via a "text messages" regarding the incident and the school reportedly did not assist the family. "I have taught my daughter to understand touch, and that's why she could tell me all that", the mother said.

"She (the victim) tried pushing him (the juvenile in conflict with law), but could not get away as the other children had left and there was no staff around", the mother stated in her FIR to the police.

She further added that there was no ayah or teacher in the washroom or classroom at the time of the alleged assault. We are also looking for CCTV footage or if anything was captured.

Meanwhile, the experts have advised the investigators to handle the case with sensitivity.

While, NDTV reported that the school has said that it was "impossible" that 4-year-old girl was sexually assaulted by another classmate of the same age, their lawyer had earlier denied charges of negligence.
