The Commerce Department determined that exporters from Canada have sold softwood lumber the United States at 3.20 percent to 8.89 percent less than fair value. To counteract unfair subsidies, countries may also introduce countervailing duties.

As a result of the findings, Commerce instructed U.S. Customs and Border Protection to collect import duties averaging 20.83 percentt on Canadian lumber imports.

The United States Department of Commerce has announced its final determination of duties of 20.83% to be applied to the majority of Canadian softwood lumber shipments entering the U.S.

"As we have consistently said, these duties are unwarranted and this trade action is completely without merit", said Susan Yurkovich, president of the B.C. Lumber Trade Council.

Zoltan van Heyningen, executive director of the U.S. Lumber Coalition, denied that the American industry was the barrier to a deal.

The final countervailing duty rate is 14.25%, decreased from the preliminary rate 19.88%, and the final anti-dumping duty rate is 6.58%, a decreased form the preliminary rate 6.78%.

"This trade action is being driven by the protectionist United States lumber lobby, whose sole objective is to constrain imports of high-quality Canadian lumber and to drive up lumber prices for their own benefit", said Susan Yurkovich, president of the BC Lumber Trade Council.

Also excluded is USA lumber shipped to Canada for some processing and imported back into the United States, certain box spring kits, and box-spring frame components. These duties are a tax on American middle-class families too, whose homes, renovations and repairs will only be more expensive. If the ITC finds that USA producers were not injured by Canadian softwood imports, the Commerce Department's case will be terminated. An earlier version said Resolute was the only producer to have its duties raised. In addition, it concluded that Canada is providing unfair subsidies to its producers at rates from 3.34 percent to 18.19 percent.

The ministers said Ottawa will turn to litigation if required to defend the industry and expects to prevail as it has in the past. "This decision is based on a full and unbiased review of the facts in an open and transparent process that defends American workers and businesses from unfair trade practises". Meanwhile, U.S. home builders are fighting the tariffs because they raise the price of home construction.

Freeland and Carr said that the Canadian Government is reviewing its options, including the possibility of legal action through NAFTA and the WTO. Canadian unions and lumber companies fear the issue will eventually cause layoffs.

Last year, the United States imported about $5 billion worth of lumber of Canada.
