Morgan Tsvangirai's ally and Kenyan opposition leader, Raila Odinga has played a Tsvangirai 2008 by pulling out of October's election re-run.

Kenya's opposition leader Raila Odinga said on Tuesday he will not participate in the re-run of a presidential election proposed for 26 October unless electoral officials make necessary reforms.

The election which saw the announcement of incumbent Uhuru Kenyatta as victor, was annulled by the supreme court and has been re-scheduled for October 26.

Odinga petitioned the country's Supreme Court to throw out the results of the first presidential elections and they did.

But in a 32-point statement in solidarity with Mr. Odinga's decision, National Super Alliance (NASA) insisted that the upcoming election should be held to the standard ordered by the Supreme Court, that is,"in strict conformity with the Constitution and written law".

The court ordered a fresh election between the original candidates of the August 8 poll, and if that does not take place the court will annul results of the new vote because it did not abide by the order, he said.

Odinga had petitioned the court, claiming the electoral body's computers were hacked to rig the results in Kenyatta's favor, who won by almost 1.4 million votes.

Based on the Supreme Court's decision, Kenyatta can not run alone on the ballot or be sworn in automatically, said Ndungu Wainaina, executive director of the International Center for Policy and Conflict.

The electoral commission on September 21 postponed the new vote to October 26 after the French firm supplying the voting technology said it would not be ready in time.

The commissioner has tweeted that it will communicate the way forward following the new developments.

During a press conference in Nairobi, he said he could not be sure that the October 26 poll would be free, fair and credible so he dropped out.

At least 37 people, including three children, were killed in the protests that followed the announcement of the elections result in Kenya, a local human rights group said.

Odinga, who has been a presidential candidate on four occasions, accused IEBC stalling any changes to its operations and personnel that led to the invalidation of the elections.

Earlier this week, hundreds of people protested in several Kenyan cities to support NASA's push for electoral reforms, with one protester shot and wounded in Nairobi and several others injured.

Kenyan police were blamed for a third of more than 1 100 deaths in 2007 when the country faced its deadliest ever post election dispute.

Even with this, the coalition's countrywide demonstrations against the IEBC will continue on Wednesday and Friday, this week.
